'Unfortunate distinction': David Tamihere's lawyer on why Crown not seeking retrial
The Crown has cited troubles with evidence - in deciding not to retry David Tamihere for the murders of Swedish backpackers Urban Hoglin and Heidi Paakkonen.
He served 20 years in prison - but in March the Supreme Court ruled his original 1990 trial was unfair.
The court didn't allow a full exoneration, and Prosecutor Claire Paterson says there's no longer sufficient evidence for a retrial.
Tamihere's lawyer Murray Gibson says the evidence suggests he wasn't involved, but it's not sufficient enough to support a re-trial.
"Unfortunately, he stumbled across a car that had been left behind in the wake of the people who were responsible for the crime, and it put him in the frame."
